This Indenture made the second day of December in the year of our Lord One thousand eight hundred and thirty BetweenThomas Shurrock of the City of Oxford Sawyer and Martha his Wife (which said Martha Shurrock is the only ¶ surviving Child of Thomas Ball formerly of Kirtlington in the County of Oxford Yeoman by Hannah his wife all other the children ¶ of the said Thomas Ball by the said Hannah his wife having died in their infancy and unmarried and which said Martha Shurrock is also the heir at Law of the said Thomas Ball deceased) of the first part William Folker of Tackley in the ¶ County of Oxford Gentleman of the second part and William Eaton Burrows of the City of Oxford Gentleman of the third ¶ £1.10 -3/6 part Now this Indenture Witnesseth that for and in consideration of the sum of One hundred and ten pounds of lawful money of the United Kingdom current in Great Britain to the said Thomas Shurrock and Martha ¶ his wife in hand paid by the said William Folker at or before the sealing and delivery of these presents the reciept whereof they the said Thomas Shurrock and his Martha his wife do and each of them doth acquit release and ¶ discharge the said William Folker his heirs executors and administrators and every of them for ever by these presents They the said Thomas Shurrock and Martha his wife have and each of the hath granted bargained ¶ sold alieved released and confirmed and by these presents do and each of them doth grant Bargain sell alien release and confirm unto the said William Folker (in his actual possession now being by virtue of a Bargain ¶ and sale to him thereof made by the said Thomas Shurrock and Martha his wife in consideration of five shillings by Indenture bearing date the day next before the day of the date of these presents for one whole year commencing from the day next ¶ before the day of the date of the said Indenture of Bargain and sale and of force of the Statute made for transferring uses into possession and to his heirs All those four acres of Arable land lying and being in the fields of Takley in the County of Oxford ¶ containing so much by estimation be the same more or less and hereinafter particularly mentioned and described (that is to say) two acres therof shooting into Banbury Way the Land formerly of John Swift on the South and two acres residue thereof lying next ¶ to the Heath called Tackley Heath shooting upon the Lands formerly of Francis Walker on the South And also all that piece or parcel of Meadow Ground containing by Estimation one Land be the same more or less situate lying and being in the Meadow ¶ of Tackley aforesaid betwixt Tackley Mill Breach and a Meadow called Bridge Meadow Together with Commons and Common of pasture for Twenty sheep and three Beasts to go depasture and feed and to be had and taken in and upon the Commons ¶ and Commonable places of Tackley aforesaid And all and singular houses hedges ditches mounds fences ways paths passages waters watercourses profits commodities emoluments and appurtenances whatsoever to the said hereditaments and ¶ premises hereinbefore granted and released belonging or in anywise appertaining And the reversion and reversions remainder and remainded yearly and other rents issues and profits of all and singular the said premises And all the estate right ¶ title interest use baist properly claim and demand of the said Thomas Shurrock and Martha his wife in to and upon the same premises To have and to hold the said four Acres of Arable Land and also the said piece or parcel of Meadow ¶ ground Commons and Common of pasture and all other hereditaments hereby granted and released or intended so to be unto the said William Folker his heirs and assigns To such uses upon such baists and to and for such intents and ¶ purposes and under and subject to such powers provisoes and declarations as the said William Folker by any deed or deeds in writing or writings with or without power of revocation to be by him sealed and delivered in the presence of and ¶ attested by two or more witnesses or by his last Will and Testament in writing or any Codicil thereto to be by him signed and published in the presence of and attested by three or more Witnesses shall from time to time direct or appoint And in default of ¶ such direction or appointment To the use of the said William Folker and his assigns during his life and from and after the determination of that estate in his life time To the use of the said William Eaton Burrows and his assigns during the life of ¶ the said William Folker In trust for the said William Folker and his assigns and from and after the determination of the Estate so hereby limited in use to the said William Eaton Burrows and his heirs as aforesaid To the use of the heirs and ¶ assigns of the said William Folker for ever And the said Thomas Shurrock doth hereby for himself and heirs and for the said Martha his wife and her heirs doth covenant promise and agree to and with the said ¶ William Folker his heirs and assignes that they the said Thomas Shurrock and Martha his wife shall and will as of last Michaelmas term next Hilary term or some subsequent term make do acknowledge and levy ¶ in due form of Law before the Justices of His Majestys Court of Common Pleas at Westminster one or more fine or fines Sur conuzancede droit comr as &c to be engrossed recorded and sued forth with proclamations according to ¶ the common course of such fines unto the said William Folker and his heirs of all the said four acres of Arable Land piece or parcel of meadow ground and common of pasture and Hereditaments hereby granted and ¶ released by such apt and convenient names quantities of land and other descriptions as will comprize the same and shall be thought fit And it is hereby declared and agreed to be the true intent and meaning ¶ of these presents and of the parties hereto that the said fine so hereby covenanted to be levied of the said hereditament and premises either alone or jointly with any other Hereditaments shall be and enure and shall be deemed adjudged ¶ construed and taken to be andenure as to for and concerning the said Hereditaments and Premises hereby grants and Released To the uses upon the buists and to and for the intents and purposes nereinbefore expressed and declared of and concerning the same And the said Thomas Shurrock for himself ¶ his heirs executors and administrators and for the said Martha his wife and her heirs doth covenant promise and agree to and with the said William Folker his heirs and assigns by these presents in manner ¶ following (that is to say) that the said Martha is lawfully and rightfully seized of an indefeazible Estate of Inheritance in fee simple or fee paid of the said Hereditaments and premises hereby granted released ¶ and that they the said Thomas Shurrock and Martha his wife have in themselves or one of them hath in himself or herself good right full power and authority by these presents and by the five hereinbefore covenanted ¶ to be levied to convey and assure the same Hereditaments and premises To and upon the uses and trusts and with the powers hereinbefore declared and contained thereof according to the true intent and Meaning of those ¶ presents And that the same hereditaments and premises shall and may from time to time and at all times hereafter be peaceably and quietly held occupied and enjoyed and the rents thereof had and taken ¶ accordingly by the said William Folker his heirs appointees and assignes without any interruption claim or demand of the said Thomas Shurrock and Martha his wife or either of them or any person or persons ¶ claiming through or under them or either of them or the said Thomas Ball deceased And that - free and clear and freely and clearly azquitted exconcrated and discharged of and from all incumbuances whatsoever by from or under the ¶ said Thomas Shurrock and Martha his wife or the said Thomas Ball deceased or any or other of them And further that he the said Thomas Shurrock and Martha his Wife and all persons claiming any estate right ¶ title or interest into or out of the said Hereditaments and premises hereby granted and released by from or under them or either them or by from or under the said Thomas Ball deceased shall and will apon ¶ every reasonable request and at the proper courts and charges of the said William Folker his heirs appointed and assignes make do acknowledge levy suffer and execute all such further and other lawful and ¶ reasonable Acts deeds conveyances and assurances for the better and more satisfactorily conveying and assuring the said hereditaments and premises hereby granted and released To the uses and upon the trusts ¶ aforesaid or as by the said William Folker his heirs or assigns or his or their Counsel shall be reasonably devised and required In Witness whereof the said parties to these presents have hereunto set their ¶ hands and seals the day and year first above written
